General
- The totalwar.com web site and service available at http://www.totalwar.com ("totalwar.com") is an online service run and owned by SEGA Europe Limited through The Creative Assembly Limited ("The Creative Assembly") to provide information and services relating to the Total War series of games namely Shogun: Total War, Shogun: Total War - The Mongol Invasion, Medieval: Total War, Medieval: Total War - Viking Invasion, Rome: Total War and Rome: Total war – Barbarian Invasion (“Total War Games”).
- These terms and conditions ("Terms") apply to all and any use of totalwar.com and all and any postings, emails and other communications made to or using it or any forum or service run by The Creative Assembly or any other party through totalwar.com ("Submissions").
- By using totalwar.com you agree to be bound by these Terms.
- If you do not accept these Terms you should not use totalwar.com or make any Submissions.
- The Creative Assembly may make alterations to these terms and conditions from time to time and these variations shall become effective immediately upon being accessible from www.totalwar.com.
Copyright and Trade Marks
- All copyright, design rights, database right, patents, and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any applications therefor ("Intellectual Property Rights") in totalwar.com belong to and vest in The Creative Assembly, or are licensed to The Creative Assembly, including in the design, layout, look and feel, graphics and images unless otherwise specified. All such rights of The Creative Assembly are hereby asserted and reserved.
- All Intellectual Property Rights in the Total War Games including without limitation all software, design, look and feel, characters, rules, gameplay, features and characteristics belongs to and vests in The Creative Assembly.
- The Creative Assembly, Total War, Medieval: Total War, Viking Invasion, Shogun: Total War, Mongol Invasion, Rome: Total War, Barbarian Invasion and the Total War logo are trademarks or registered trademarks of The Creative Assembly in the United Kingdom, United States and/or other countries.
- SEGA and the SEGA logo are registered trade marks or trade marks of the SEGA corporation.
- DirectX, Direct 3D,DirectSound, DirectDraw, Windows and Microsoft are trade marks or registered trade marks of Microsoft Corporation in the United Kingdom, United States and/or other countries.
- QSound and the Q Logo are registered trade marks of QSound Labs, Inc. "Environmental Audio" is a trade mark and the Environmental Audio Logo is a registered trade mark of Creative Technologies Ltd in certain countries.
- All other trade marks are the property of their respective owners and The Creative Assembly makes no warranty or representation in respect of any trade mark.
Use of totalwar.com and Total War Games
- The Creative Assembly hereby grants you a personal, non-exclusive, non-transferable and non-assignable license to use and display, for home, non-commercial and personal use only, material hosted on the totalwar.com site, including, but not limited to, any files, codes, audio or images incorporated in or generated by it and its software (“Downloaded Content”).
- You must include or maintain all copyright and other notices contained or associated with such Downloaded Content.
- You may not without the prior written consent of The Creative Assembly and its Licensees:
- distribute, modify, transmit, re-use, re-post, or use any or all of totalwar.com or the information contained therein for any purpose other than as set out above nor for public or commercial purposes;
- provide hypertext links, URL Links, graphic links, hyperlinks or other direct connection for profit or gain to totalwar.com;
- display, publish, copy, print, post or otherwise use totalwar.com and the information contained therein for the benefit of any other website;
- process or otherwise use the information contained on or within totalwar.com for any illegal or immoral purpose nor use or process the same unfairly;
- sublicense, assign or otherwise transfer this license or the Downloaded Content and no title to the Downloaded Content has been or will be transferred to you from The Creative Assembly or anyone else;
- alter, disassemble, decompile, reverse engineer or otherwise modify the Downloaded Content;
- use any The Creative Assembly materials or any materials contained in any Total War Games on any web sites.
- In the event that any consent is given, you must include all copyright, trade mark and other notices as appropriate.
- Consent will not be given in particular in relation to any web site that features unlawful, racist, defamatory, pornographic, inflammatory, or other legally restricted content, including, but not limited to, hacks for any The Creative Assembly games or any other content that The Creative Assembly find objectionable or unlawful. - The Creative Assembly and its Licensees:
- reserve the right to refuse permission to host or distribute its patches and demos to anyone, for any reason, at any time;
- prohibit the sale or other commercial exploitation of any CD or other media containing maps, add-ons or campaigns found on the Internet or otherwise for any game or product produced by The Creative Assembly without prior written consent;
- do not permit, authorise, support or condone the use or distribution of unofficial cheats and/or hacks for use with any The Creative Assembly product;
- do not support or condone network/internet play of the Total War Games anywhere but on gamespy.com or through totalwar.com unless agreed otherwise or as specifically provided by the particular Total War Game or totalwar.com. Specifically, you may not host or provide matchmaking services for any of our games or emulate or redirect the communication protocols used by The Creative Assembly or in the network feature of its games, through protocol emulation, tunnelling, modifying or adding components to the game(s), use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilising commercial or non-commercial gaming networks or as part of content aggregation networks without the prior written consent of The Creative Assembly;
- The Creative Assembly reserve the right to revoke this limited use license at any time, for any reason, and at the sole discretion of The Creative Assembly.
Liability
- The Creative Assembly provides and maintains totalwar.com for personal entertainment and information about the Total War Games and services free of charge and on an as is basis.
- The Creative Assembly shall be liable only to provide totalwar.com with reasonable skill and care and gives no other warranty in connection with totalwar.com.
- The Creative Assembly shall have no liability in respect of any other web site or page on the internet accessible from totalwar.com or any other web site. Third party websites with links from totalwar.com have not been verified or reviewed by The Creative Assembly and use and access of such is made at your own risk.
- Subject as aforesaid, to the maximum extent permitted by law, The Creative Assembly excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to The Creative Assembly and The Creative Assembly shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
- any incorrect or inaccurate information on totalwar.com and all interruptions to or delays in updating the service;
- the infringement by any person of any Intellectual Property Rights of any third party caused by their use of totalwar.com;
- any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading totalwar.com, or from transmissions via emails or attachments received from The Creative Assembly or its licensees;
- all representations, warranties, conditions and other terms which but for this notice would have effect.
- Your statutory rights as a consumer are available to you and these terms shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall it exclude or limit The Creative Assembly's liability for death or personal injury resulting from its negligence nor any fraudulent representation.

Chat Rooms and Discussion Forum
- The Creative Assembly runs a forum for the exchange of views relating to Total War Games on totalwar.com and for fans and players of these games and other products and services to interact. As such it is a mere conduit engaged in the business of providing an entertainment and information service and is engaged in the transmission, storage, retrieval, hosting, formatting or translation of third party communications without selection or alteration of the content of the communications (“Submissions”).
- You agree and accept that The Creative Assembly has no responsibility to review the content of the Submissions on totalwar.com all of which are made available on the basis that The Creative Assembly shall not be required to exercise any control or judgement of the content or the material posted or contained therein.
- The views expressed in any Submissions are the views of the individual contributors and not those of The Creative Assembly unless specified otherwise by The Creative Assembly.
- In particular but without limitation to the above The Creative Assembly is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any Submissions.

Termination
- The Creative Assembly shall be entitled to immediately remove, cancel or suspend access to and use of totalwar.com upon your breach of any part of these Terms whatsoever.
- Termination shall be without prejudice to any accrued rights.
- The Creative Assembly will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.

- Except as provided above there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law (but subject to your statutory and common law consumer rights).
